1. Acceptance of Terms

By accessing or using the Wind Academy OS platform and mobile application (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

The Wind Academy OS is a training management and workforce marketplace platform that connects training providers, businesses, employment agencies, and workers. The Service includes course booking, certification management, digital competence passports, job booking, document sharing, and membership management.

3. User Accounts

You must register an account to access most features. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorised use of your account

4. Membership & Subscriptions

Certain features require a paid membership (Silver, Gold, or Platinum tier). Memberships are billed monthly or annually via Stripe. You may cancel your membership at any time; access continues until the end of the current billing period. Refunds are handled in accordance with our cancellation policy.

5. Training & Certification

Certificates issued through the Service are subject to the accreditation requirements of the relevant governing bodies (GWO, IOSH, etc.). Certificate validity is determined by the training provider and accreditation body, not solely by The Wind Academy. Falsifying certificate data or identity is strictly prohibited and may result in immediate account termination.

6. Worker & Job Bookings

The Service facilitates bookings between businesses/agencies and workers. The Wind Academy acts as a platform provider and is not a party to any employment or contractor agreement between users. Terms of engagement, payment, and liability are solely between the contracting parties.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any law
Upload false, misleading, or fraudulent documents or qualifications
Harass, abuse, or harm other users through the platform's messaging features
Attempt to access, tamper with, or disrupt the Service's infrastructure or data
Reverse engineer, decompile, or disassemble any part of the Service

8. User Content

You retain ownership of content you upload (documents, CVs, certificates, photos). By uploading, you grant The Wind Academy a licence to store, display, and share this content as necessary to provide the Service (e.g., sharing certificates with verification links, sharing documents with assigned trainers).

9. Intellectual Property

The Service, including its design, branding, software, and content not provided by users, is the property of The Wind Academy and protected by intellectual property laws. Training materials and course content remain the property of the respective training providers.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not liable for the actions or omissions of other users, including training providers, employers, workers, or agencies.

11. Limitation of Liability

To the maximum extent permitted by law, The Wind Academy shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the preceding 12 months.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Certain data may be retained after termination as required by accreditation and legal obligations.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
